IF YOU ENTER YOU ARE UNCONDITIONALLY AGREEING TO ACCEPT AND BE BOUND BY THESE OFFICIAL RULES AND THAT ALL DETERMINATIONS OF THE SPONSOR ARE FINAL AND BINDING. WE MAY REQUIRE YOU TO CONFIRM YOUR COMPLIANCE WITH THESE OFFICIAL RULES IN ORDER TO DECLARE YOU A WINNER AND/OR AWARD ANY PRIZE TO YOU.
The dates for entering (both beginning and end) are indicated on the Sweepstakes promotional materials. All times are local time to the retail home center sponsoring the Sweepstakes.
1. You must be a legal resident of Georgia, and at least 18 years of age or older. Employees, agents (of ours, or any affiliate, subsidiary, promotional partner or advertising agency), members of their immediate families or persons living in the same household are not eligible to enter or win.
2. To enter the Sweepstakes, fill out an entry form and place it in the receptacle provided or give it to the Sponsor representative at the location where you received it before the entry period ends. Only one entry per person is permitted. No other entries or entry forms will be accepted. We are not responsible for lost entries and may disqualify any incomplete, invalid or illegible entries. The number of potential winners, prizes and the approximate retail value the prizes will be shown on the promotional materials announcing the Sweepstakes. No substitutions or prizes are permitted, although we can substitute a prize of equal or greater value if, for any reason, we cannot award the prize indicated. All taxes and costs associated with winning, receiving, accepting or using any prize are solely your responsibility.
3. Winners will be determined by random drawing from all eligible entries received. The drawing will generally be held within 30 days after the entry period ends at our offices or such other location as disclosed in the Sweepstakes promotional materials. We will attempt to notify winners by phone and/or U.S. mail. We are not responsible for any late, lost or misdirected notification and if, for any reason within 10 days after we draw your entry, we cannot notify you, you do not respond to our notifications or you fail to sign and return an affidavit of eligibility/release of liability, and where lawful, a publicity consent agreement or other documents we require (if any), we have the right to disqualify your entry and select another from the remaining eligible entries. Except where prohibited or restricted by law, when you are declared a winner or accept any prize, you are agreeing we have the right to use your name, voice, likeness, hometown and state of residence for advertising or promotion without notice or other compensation.
4. We may disqualify you if you fail to comply with these Official Rules or if we believe you have or are tampering, interfering with or disrupting any entries or the operation of the Sweepstakes. We reserve the right, in our sole discretion, to terminate, cancel or modify the Sweepstakes at any time, for any reason unless prohibited by law. If we delay or fail to enforce our rights that doesn’t mean we waive them. By entering you are agreeing to release and hold harmless us and our employees and agents, from all claims, losses and damages resulting from your entry in the Sweepstakes and your acceptance, possession and use of any prize. The interpretation of these Official Rules and all disputes and causes of action arising out of this Sweepstakes, other than determinations of the Sponsor under these Official Rules, shall be subject to the laws and the exclusive jurisdiction of the courts in which Sponsor’s principal office is located as set forth below. All claims, judgments and awards to you, if any, shall be limited to actual out-of-pocket costs incurred by you as necessary to participate in this Sweepstakes, but not attorneys’ fees or costs or any incidental or consequential damages.
5. You may request a list of winners after the drawing by writing to us at Clayton Homes of Augusta, 1919 Gordon Hwy, Augusta, GA 30909 with the month and year in which the Sweepstakes ended and the words “SWEEPSTAKES WINNERS LIST” on the outside envelope and enclosing a self-addressed, postage prepaid envelope. Requests must be received within 3 months after the end of the Sweepstakes.
6. The Sponsor of this Sweepstakes is Clayton Homes of Augusta, 1919 Gordon Hwy, Augusta, GA 30909 owned and operated by CMH Homes, Inc. with its principle place of business at 5000 Clayton Road, Maryville, TN 37804.
7. Information collected on the entry form is subject to the Sponsor’s Privacy Policy at https://www.claytonhomes.com/privacy/multi-state-privacy-policy/. By accepting the terms of these Official Rules by entering the Sweepstakes, entrant gives his or her express consent to receiving promotional materials including without limitation emails containing information about CMH and its products.
